    Terms of Service

    These Terms of Service govern your use of the Rally platform operated by RallyGroup Pty Ltd (ABN 20 208 724 667). By using Rally, you agree to these terms.


    1. WHO WE ARE

    2. WHAT RALLY IS (AND IS NOT)

    Rally is a workforce mental health monitoring tool. It provides:

  1. Anonymous daily check-ins for workers
  2. Aggregate trend data for leaders and employers
  3. WHS psychosocial hazard monitoring documentation
  4. Rally is NOT a clinical mental health service. Rally does NOT provide medical advice or diagnosis. Rally does NOT provide crisis intervention.

    3. YOUR ACCOUNT

    You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorised access at travis@rallyapp.com.au.

    You must be 18 or older to create an employer/leader account. Workers using the platform must be employed by a subscribing organisation.


    4. EMPLOYER OBLIGATIONS

    By using Rally as an employer or leader, you agree to:

  5. Not attempt to identify individual workers from aggregate data
  6. Not use Rally data to penalise, disadvantage, or discriminate against any worker
  7. Not share Rally compliance reports with third parties without appropriate legal basis
  8. Maintain your own WHS obligations independently of Rally
  9. Comply with the WA Work Health and Safety Act 2020 and all applicable laws and regulations
  10. Rally provides monitoring data. Employers remain responsible for the welfare of their workforce and for taking appropriate action in response to that data.


    5. WORKER ANONYMITY

    Rally is built on a technical anonymity model. Your employer cannot see your individual check-in responses. The Rule of 5 threshold ensures aggregate data is only shown when 5 or more workers have checked in.

    However, no system is completely infallible. Workers should exercise their own judgment about what information they share in the Crib Room (peer chat) as messages there may be visible to other workers in your team.


    6. ACCEPTABLE USE (CRIB ROOM)

    The Crib Room is an anonymous peer support space. You agree not to:

  11. Post content that is abusive, threatening, or harassing
  12. Share personal identifying information about yourself or others
  13. Post content that is illegal or promotes illegal activity
  14. Impersonate other workers or Rally staff
  15. Rally reserves the right to remove content that violates these guidelines and to suspend accounts that repeatedly breach them.


    7. SUBSCRIPTION AND PAYMENT

    Rally is offered on a subscription basis. By subscribing you agree:

  16. To pay the applicable fees as listed on the pricing page
  17. That your subscription will renew automatically unless cancelled
  18. To cancel at least 24 hours before your renewal date to avoid being charged for the next period
  19. That payments are processed by Stripe and subject to their terms of service
  20. 90-day pilot: No credit card is required to start a pilot. After 90 days, continued use requires a paid subscription.

    Refunds: We offer refunds within 14 days of initial payment if Rally has not performed as described. Contact travis@rallyapp.com.au.


    8. DATA AND PRIVACY

    Your use of Rally is also governed by our Privacy Policy at rallyapp.com.au/privacy. By using Rally you agree to the collection and use of your data as described in that policy.

    On cancellation: your data is retained for 12 months after cancellation and then permanently deleted, unless you request earlier deletion.


    9. LIMITATION OF LIABILITY

    To the maximum extent permitted by Australian law:

  21. Rally provides the platform on an "as is" basis. We do not guarantee uninterrupted or error-free service.
  22. Rally's total liability to you for any claim arising from your use of the platform is limited to the total fees you paid in the 3 months preceding the claim.
  23. Rally is not liable for any indirect, consequential, or incidental loss or damage arising from your use of the platform, including but not limited to: decisions made based on platform data, failure to identify a worker welfare issue, or data loss due to technical failure.
  24. Nothing in these terms excludes liability that cannot be excluded under Australian Consumer Law.


    10. INTELLECTUAL PROPERTY

    Rally and all content, features, and functionality of the platform are owned by RallyGroup Pty Ltd and protected by Australian and international copyright and intellectual property laws.

    You may not copy, modify, distribute, or reverse-engineer any part of the platform without our written permission.


    11. GOVERNING LAW

    These terms are governed by the laws of Western Australia, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Western Australia.


    12. CHANGES TO THESE TERMS

    We may update these terms from time to time. The date at the top of this page shows when they were last updated. Continued use of Rally after an update constitutes acceptance of the revised terms.

    For significant changes we will notify subscribers by email.
